Privacy Policy

Who we are

Digital Apex Marketing LLC ("Digital Apex," "we," "us") is a marketing and business automation company based in Arizona, United States. We build and operate marketing systems, CRM workflows, content pipelines, and AI agents. Some of these run inside our own accounts. Others are licensed to or operated on behalf of client companies.

Who this policy covers

This policy applies to three groups:

  • Visitors to digitalapexmarketing.com
  • Clients who engage us for services or license an AI agent from us
  • Individuals whose data we handle on a client's behalf, where the client, not Digital Apex, decides what is collected and why

Information we collect

Information you give us directly. Your name, email address, phone number, business name, and anything else you send us through a form, an email, a scheduled call, or a message on a social platform.

Information collected automatically. Standard technical data when you visit our website: IP address, browser and device type, pages visited, and referring site, collected through cookies and similar technologies.

Information from platforms you authorize. When you engage us, you may authorize us to access accounts you control, such as your CRM, email platform, cloud storage, or social accounts. We receive whatever those platforms expose under the permissions you grant.

How we use information

  • to respond to enquiries and deliver the services you have asked for
  • to operate, maintain, and improve our services, our website, and our AI agents
  • to send service communications, and marketing communications you have opted in to
  • to meet our legal, tax, and accounting obligations

We do not sell your personal information.

AI agents and automated processing

A significant part of what we do is operating software agents that act on data with limited human involvement at each step. Because that is unusual enough to deserve plain description, here is how it works.

What our agents do. Our agents perform defined business tasks: retrieving and organizing files, producing and scheduling content, maintaining spreadsheets and records, managing calendars, researching publicly available business information, and drafting communications for human review. Our podcast production agent, for example, retrieves episode recordings from cloud storage, generates short clips, drafts caption copy, and prepares those drafts for approval. We expect to offer additional agents over time, including agents licensed to client companies to run inside their own systems.

Human oversight. Actions that publish content, send messages to third parties, or spend money require a human decision. Our agents prepare and propose; a person approves. Where a client configures an agent differently, that is the client's decision and their responsibility.

Language models. Our agents use third party AI model providers to generate and analyze text. Content necessary to perform a task may be sent to those providers. We use providers on terms that prohibit training their models on our submitted content, and we do not submit personal data to them beyond what a task requires.

No automated decisions with legal effect. We do not use AI agents to make decisions about individuals that produce legal or similarly significant effects, such as decisions about credit, employment, housing, or insurance.

Google API Services user data

Our agents connect to Google accounts that we own, or that an account holder has explicitly authorized through Google's consent screen.

What we access. Depending on the authorization granted, our software may read Google Drive files, read Gmail messages, and read or write Google Sheets, Google Docs, Google Calendar, and Google Contacts.

Why we access it. Solely to perform the business automation described above: retrieving podcast recordings from Drive, assembling content and reporting spreadsheets, managing calendars, and organizing business correspondence. We do not access Google user data for any purpose unrelated to the task the account holder authorized.

Limited use. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. Specifically:

  • we use Google user data only to provide or improve the user-facing features described above
  • we do not transfer Google user data to third parties except as necessary to provide or improve those features, to comply with applicable law, or as part of a merger or acquisition
  • we do not use Google user data for advertising
  • we do not use Google user data to train generalized AI or machine learning models
  • we do not allow humans to read Google user data unless we have the account holder's explicit consent, it is necessary for security purposes or to comply with applicable law, or the data has been aggregated and anonymized

Storage and revocation. Access tokens are stored on machines and systems we control and are not shared with third parties. Any account holder may revoke our access at any time at myaccount.google.com/permissions. Revoking access stops all further access immediately.

When we handle data on a client's behalf

When we operate an agent or a system inside a client's accounts, the client determines what data is processed and for what purpose. In that arrangement the client is the controller of that data and Digital Apex acts as a processor on the client's documented instructions. In that role we:

  • process client data only to deliver the agreed services
  • do not use client data to train models, build our own datasets, or market to the client's contacts
  • return or delete client data at the end of an engagement, on request
  • require the same commitments from any subprocessor we use

Individuals who want to exercise rights over data we hold on a client's behalf should contact that client directly. If they contact us instead, we will refer the request to the client and assist as the client instructs.

Service providers and subprocessors

We share information only with providers who help us operate, including customer relationship management, email delivery, hosting and storage, analytics, media processing, AI model providers, and payment processing. They may only use the information to perform services for us. We also disclose information where we are legally required to do so.

Data retention

We keep business records for as long as needed to deliver our services and satisfy legal and tax obligations, which for financial records generally means seven years. Marketing contact data is kept until you unsubscribe or ask us to delete it. Client data processed on a client's behalf is kept for the duration of the engagement and then returned or deleted.

Security

We use reasonable administrative and technical safeguards, including access controls, encrypted transport, and restricted credential storage. Access to client systems is limited to the permissions a task requires. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your rights

You may ask us what personal information we hold about you, and ask us to correct it, delete it, or stop sending you marketing. Contact us at the address below and we will respond within the time required by applicable law.

Children

Our services are not directed to anyone under 18, and we do not knowingly collect personal information from children.

Changes to this policy

We may update this policy. When we do, we will change the effective date at the top. Material changes affecting active clients will be communicated to them directly.

Terms of Use

Acceptance

These Terms of Use govern your use of digitalapexmarketing.com and any software, agent, or service operated or licensed by Digital Apex Marketing LLC. By using the site or engaging our services, you agree to these terms. You must be at least 18 and able to enter a binding contract.

Our services

We provide marketing and business automation services, including CRM configuration, workflow and content automation, campaign management, consulting, and the development, licensing, and operation of AI agents. The scope, deliverables, timeline, and fees for any engagement are set out in a separate proposal, statement of work, or service agreement. Where those documents conflict with these terms, those documents govern.

Nothing on this website is an offer or a guarantee of any particular business result.

AI agent services

What an agent is. An AI agent we provide is software that performs business tasks using language models and connected accounts. It is a tool operating on your instructions and configuration, not an employee, an advisor, or a licensed professional.

Output is drafted, not certified. AI output can be inaccurate, incomplete, or inappropriate for a given context. You are responsible for reviewing output before it is published, sent, filed, or relied on. Do not use our agents to produce legal, medical, financial, or other professional advice without qualified human review.

Authorizations you grant. Where an agent needs access to your accounts, you grant that access yourself and may revoke it at any time. You confirm you have the authority to grant it, and that doing so does not breach your agreements with those platforms.

Your configuration is your responsibility. Where we hand you controls over an agent's autonomy, including which actions it may take without human approval, the settings you choose and their consequences are yours.

Acceptable use. You may not use our agents to generate unlawful, deceptive, harassing, or infringing content, to send unsolicited messages in breach of applicable law, to impersonate any person or organization, to scrape or access systems without authorization, or to process sensitive categories of personal data without a lawful basis and our prior written agreement.

Client responsibilities

  • provide accurate information and timely access to the accounts and assets we need
  • hold the rights to any content, branding, or data you ask us to use
  • maintain your own compliance obligations, including consent for any contact lists you provide
  • review deliverables and respond within the timeframes agreed in your engagement

Fees and payment

Fees, billing cadence, and payment terms are set out in your engagement documents. Invoices unpaid past their due date may result in paused work or suspended agent operation. We do not refund work already performed.

Intellectual property

Site content, including text, graphics, logos, and software, is owned by Digital Apex or our licensors. You may not copy, republish, or create derivative works from it without our written permission.

Work product created for a client transfers to that client on full payment. Our pre-existing and independently developed tools, agent architectures, prompts, templates, frameworks, and know-how remain ours, including where they were refined during your engagement, and we may reuse them. Where an agent is licensed rather than sold, you receive a non-exclusive, non-transferable right to use it for the term of your agreement.

As between you and us, content an agent generates from your inputs is yours. AI-generated material may not be eligible for copyright protection in every jurisdiction, and similar output may be generated for others.

Confidentiality

Each party will protect the other's non-public business information and use it only to perform the engagement. This obligation survives termination.

Third party platforms and model providers

Our services operate inside third party platforms, including CRMs, advertising networks, social platforms, cloud storage, and AI model providers. Those platforms set their own terms, availability, pricing, rate limits, and policies, and they change them without consulting us. We are not responsible for a third party platform's acts, outages, policy changes, model changes, or account decisions, including suspension of an account we operate on your behalf.

Disclaimers

The site, our services, and our agents are provided on an "as is" and "as available" basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that agent output will be accurate, uninterrupted, or error free.

Limitation of liability

To the fullest extent permitted by law, Digital Apex is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or reputational harm, including any arising from agent output or from action taken on it. Our total liability arising out of or relating to an engagement is limited to the amount you paid us for that engagement in the three months before the claim arose.

Term, termination, and data

Either party may end an engagement as set out in the applicable engagement documents. On termination we will disable agent access to your accounts, and return or delete your data on request. You should also revoke any access you granted directly at the relevant platform. Sections that by their nature survive termination will survive, including intellectual property, confidentiality, disclaimers, and limitation of liability.

Governing law

These terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Arizona.

Changes to these terms

We may update these terms. When we do, we will change the effective date at the top. Continuing to use the site or our services after a change means you accept the updated terms.
